Public Hearing Scheduled for HB 4141
On May 7th the House Conservation and Outdoor Recreation Committee will hold a public hearing in Lansing on House Bill 4141 (proposed road end legislation). The hearing will be held at the House Office Building (across from the State Capitol) on Capitol Avenue at 10:30 a.m.
This legislation (as currently drafted) was included in the February issue of the HLPOA's Water Lines newsletter. Basically, the language mirrors the Jacobs v Lyon Twp. appellate court decision (1994) which declared the dedication for public access includes only the right of ingress and egress to the surface water and does not include use of the public access (road end) for any of the following: (a) Boat hoists, (b) Construction of docks unless the purpose of the dock is to aid in the public access, (c) Picnicking, sunbathing, or lounging and (d) Mooring of a vessel overnight on bottomland directly offshore from a dedicated public access site.
If you haven't already made contact with members of the House Conservation and Outdoor Recreation Committee now is the time to send your letter or e-mail. The future of HB 4141 depends on favorable action by this committee. You could make the difference in passage of this important state legislation . . . by sending your message of support in advance of the May 7th public hearing.
